The Specialty Equipment Market Association (“SEMA”) wants you to know how we address privacy issues on the MOTORin’ website and mobile applications whether for tablets or mobile devices or any other platform (the “Sites”). We have established the privacy policy below (the “Privacy Policy”) to explain how your personal information will be collected and used by us. SEMA reserves the right to change this Privacy Policy at any time. Please check back frequently in order to see changes, and your use of the Sites constitutes your acceptance of the Privacy Policy and to be bound by our Terms of Use, as they may be changed from time to time.

Collection of Personal Data from Site Users

If required by applicable law, SEMA will seek your explicit consent to process personal data collected on this website or volunteered by you. Kindly note that any consent will be entirely voluntary. However, if you do not grant the requested consent to the processing of your personal data, the use of this website may not be possible. SEMA generally collects information about you to help it better understand your needs, to provide you with personalized and efficient service, and for other purposes described in this Privacy Policy. SEMA generally obtains personal data directly through the information that you provide to SEMA. When users or visitors come to our Sites, we may collect any of the following information:

We may collect and/or track (a) the home server domain names, e-mail addresses, type of computer, and type of Web browser of visitors to the Sites, (b) the e-mail addresses of visitors that communicate with SEMA or the Sites via e-mail, (c) information knowingly provided by the visitor in on-line forms, registration forms and surveys, (including name, address, e-mail and other personal profile data), and (d) aggregate and user-specific information regarding page views.

  2. We may use Internet "cookies", web beacons, or other technology to collect information from visitors' hard drives.   3. When a visitor performs a search within the Sites, SEMA may record information identifying the visitor or linking the visitor to the search performed. SEMA may also record limited information associated with every search request made by the visitor and use that information to, among other things, solve technical problems with the service and to calculate overall usage statistics.

  4. We may collect geo-location information if a visitor enables their computer or mobile device to send us location information. The visitor may be able to change the settings on their computer or mobile device to prevent it from providing us with such information.

Use of Personal Data Collected

SEMA may use personally identifiable information in a number of ways, such as:

  1. To communicate with you about your account, if applicable, or to communicate information about the Sites. For example, we may send all new users a registration email, and we will also occasionally send important notices or information.

  2. To build higher-quality, more useful services, such as by analyzing usage trends, and by measuring demographics and interests regarding specific areas of the Sites.

  2. As SEMA believes necessary to: (a) comply with law (including court and government orders, and civil subpoenas); (b) enforce or apply MOTORin’s Terms of Service and other agreements; or (c) protect the rights, property, or safety of SEMA, our users, or others.

  3. If you partake (or we reasonably suspect that you are partaking) in any illegal or potentially illegal activity. We may disclose personal data even without a subpoena, warrant, or other court order, to the extent we feel is necessary to inform and cooperate with law enforcement agencies or other appropriate authorities.

  4. In aggregated form, i.e., information about multiple users collectively without identifying any individual user, such as the total number of visitors to a particular section in a given week.

Collection of Personal Data from Children

The Sites are not intended for children under 13, and we do not intentionally gather Personal Data from visitors who are under the age of 13. If we discover that a child under 13 has submitted Personal Data to SEMA, we will attempt to delete the information as soon as possible.

Processing in the European Economic Area (EEA)

For visitors with accounts who are located in the European Economic Area (EEA), all processing of personal data is performed in accordance with privacy rights and regulations of the General Data Protection Regulation (GDPR) due to take effect on May 25, 2018. SEMA processes personal data as a Controller, as defined in the GDPR. SEMA, which you as a user entered an agreement with when using the Sites, will be the Controller for personal data, as outlined above in “Collection of User data” section.

All data collected by SEMA will be stored exclusively in secure hosting facilities provided by The Collector Car Network, Inc. SEMA has a data processing agreement in place with its provider ensuring compliance with GDPR. All hosting is performed in accordance with the highest security regulations. All transfers of data internally in the EEA is done in accordance with this data processing agreement.

Processing in the United States of America (US)

For visitors with accounts in the U.S., SEMA processes data solely in data centers located in the U.S. SEMA has adopted reasonable physical, technical and organizational safeguards which substantially mirror the EU safeguards against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of personal data in SEMA’s possession. SEMA will promptly notify the visitor in the event of any known unauthorized access to, or use of, the visitor’s data.

All data collected by SEMA will be stored exclusively in secure hosting facilities provided by The Collector Car Network, Inc. SEMA’s contract with its hosting provider ensures that all hosting is performed in accordance with the highest security regulations. SEMA’s policy is to protect and safeguard any personal data obtained by SEMA in accordance with United States state or federal laws governing the protection of personal information and data. Accordingly, SEMA adheres to practices and policies that aim to safeguard the personal data.

IN GENERAL, IF THE BUSINESS HAS MADE SUCH A DISCLOSURE OF PERSONAL DATA, UPON RECEIPT OF A REQUEST BY A CALIFORNIA CUSTOMER, THE BUSINESS IS REQUIRED TO PROVIDE A LIST OF ALL THIRD PARTIES TO WHOM PERSONAL DATA WAS DISCLOSED IN THE PRECEDING CALENDAR YEAR, AS WELL AS A LIST OF THE CATEGORIES OF PERSONAL DATA THAT WERE DISCLOSED.

Security

While no physical or electronic security system is impenetrable, SEMA strives to maintain levels of privacy and security consistent with industry standards. To protect the security of information supplied by users in order to access restricted areas, users must provide e-mail addresses and passwords to access their information. Although SEMA takes these measures to safeguard against unauthorized disclosure of a user’s data or personal information, SEMA cannot control Internet transmissions and cannot guarantee or warrant that personal information transmitted to SEMA will never be compromised.

The Sites may contain links to other Internet websites. Unless we explicitly state otherwise, we have no control over these third party sites and their privacy practices, and this Privacy Policy applies only to information you supply (or that we collect) in connection with use of the Sites. Governing Law

This Privacy Policy and the privacy practices of SEMA will be subject exclusively to the laws of the State of California within the United States of America, excluding its conflict of laws provisions, and you submit to personal jurisdiction in California. The parties irrevocably agree that the state and federal courts located in the State of California, U.S.A. shall have exclusive jurisdiction in respect of any dispute which may arise out of or in connection with this Privacy Policy. THE PARTIES HEREBY WAIVE TRIAL BY JURY. Visitors who use the Sites and reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you reside outside of the United States, by using the Sites, you consent to the transfer and use of your information outside your country.

Changes to Collection and Dissemination of Information Policy

SEMA reserves the right, at any time, to add to, change, update, or modify this Privacy Policy, simply by posting such addition, change, update, or modification on the Sites.
